About These Terms
These terms apply when you use booktheparty.com.au as a customer or visitor. They operate with our Privacy Policy, Cancellation Policy and Refund Policy. You must be at least 18 years old and able to enter a binding agreement to create an account or make a booking.
Our Marketplace Role
Book The Party provides a marketplace, booking, communication and payment platform. The vendor identified on a listing is the independent supplier responsible for the advertised goods or services. Book The Party is not the vendor unless a listing expressly says otherwise. We remain responsible for our own platform services and obligations under applicable law.
Accounts and Security
You must provide accurate information, keep it current, protect your password and promptly report suspected unauthorised access. You are responsible for activity carried out through your account unless it results from our failure to use reasonable care. We may suspend access reasonably required to protect users, investigate misuse or comply with law.
Bookings and Vendor Acceptance
Submitting payment creates a paid booking request awaiting vendor acceptance; it is not yet a vendor-confirmed booking. The vendor receives limited booking information while deciding. If accepted, the booking moves forward and the vendor receives the contact and venue details required to fulfil it. If declined, the booking is cancelled and a full refund is initiated.
You must check all selections, dates, times, addresses, access requirements and notes before paying. A booking is subject to listing conditions disclosed before checkout, provided they do not conflict with these platform terms or applicable law.
Payments and Refundable Bonds
Prices are in Australian dollars and include applicable taxes unless stated otherwise. Payments and refunds are processed by the payment methods offered at checkout. We do not store full card details.
Where a refundable bond applies, it is shown before checkout. A no-damage completion can trigger a refund. A vendor damage report places the bond into admin review; it does not automatically prove loss or finally determine that the bond is forfeited.
Pricing, Delivery and Errors
The checkout total may include the service price, selected quantities or add-ons, delivery or travel fees, bonds and discounts. We may correct a genuine pricing or technical error before vendor acceptance and will offer a full refund if you do not accept the correction. We will not retrospectively increase an accepted booking price without your agreement.
Cancellations and Refunds
The platform rules in our Cancellation Policy and Refund Policy apply to Book The Party bookings. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
Acceptable Use
You must not misuse another person’s information, attempt unauthorised access, interfere with the platform, submit fraudulent bookings or reviews, upload unlawful or infringing content, or use booking details for unsolicited marketing. Customer and vendor communications should remain relevant, respectful and lawful.
Responsibility and Liability
To the extent permitted by law, each vendor is responsible for its listings, personnel, equipment, licences, insurance and performance. Book The Party is not liable for loss caused solely by an independent vendor or customer that is outside our reasonable control. Nothing in this clause limits liability or rights that cannot lawfully be limited.
Complaints and Disputes
Report a problem promptly through your dashboard or at info@booktheparty.com.au, quoting the booking number and providing relevant evidence. We may ask both parties for information and may place a payout or bond under review while a dispute is assessed.
Content and Intellectual Property
You retain ownership of content you submit and grant us a non-exclusive licence to host, reproduce and display it as reasonably required to operate and promote the platform. You warrant that you have the rights and permissions needed for that content. Book The Party’s branding, software and original site content remain protected.
Changes and Governing Law
We may update these terms prospectively. Material changes will be notified where reasonably practicable and will not remove accrued rights from an existing booking. These terms are governed by the laws of New South Wales and Australia, and do not restrict any right to bring a claim in a court or tribunal that has jurisdiction.
